On the spot assessment of the damage/harassment done by Nigerian Police at Dele Farotimi’s office (Video)



The Nigerian Police Force has come under intense scrutiny following the arrest of Dele Farotimi, a prominent human rights lawyer and activist. The arrest, which took place on December 4th, 2024, in Lagos, was executed by operatives from the Ekiti Police Command. This action has sparked widespread condemnation, particularly from the Nigerian Bar Association (NBA), which has labeled it as a "troubling breach of the rule of law."


The circumstances surrounding Farotimi's arrest are deeply concerning. He was apprehended over allegations of libel, cyberbullying, and defamation, reportedly at the behest of Afe Babalola, a Senior Advocate of Nigeria. The NBA, through its President Afam Osigwe, has vehemently criticized the police's actions, highlighting that defamation is not recognized as a criminal offense under the laws of Lagos State. This position is supported by the Criminal Law of Lagos State 2011, which decriminalized defamation, aligning with global best practices that treat it as a civil matter.


Adding to the controversy is the reported invasion of Farotimi's law firm by police officers, who allegedly harassed lawyers and staff, confiscating their phones in the process. This act has been described as a severe disregard for the sanctity of legal practice and a violation of constitutional rights. The NBA has demanded an immediate investigation into these actions, emphasizing the need for accountability and respect for human rights.


The arrest has also drawn reactions from various quarters, including Omoyele Sowore, the presidential candidate of the African Action Congress in the 2023 elections. Sowore condemned the arrest as undemocratic and accused the police of being used to settle personal scores. He called for Farotimi's immediate release, stressing that the police should not intervene in civil matters such as defamation.


In defense of the arrest, the Ekiti State Commissioner of Police, Mr. Adeniran Akinwale, stated that the allegations against Farotimi were fully established and warranted investigation. However, this stance has been met with skepticism, as many view the arrest as an abuse of police powers and a deviation from due process.


The situation has sparked a significant outcry on social media, with calls for Farotimi's release gaining momentum. The incident highlights ongoing concerns about the misuse of law enforcement agencies in Nigeria and the need for reforms to ensure that the principles of legality, fairness, and respect for human rights are upheld.
